Engine control module data, electronic logging records, telematics pings, dashcam footage, dispatch messages, weigh-station tickets, the driver's qualification file, a serious case is won out of that material, and almost none of it belongs to you.

Forward-facing camera systems typically overwrite in days unless the event is flagged. Damaged tractors get repaired or sold. None of that is sinister; it is ordinary business. The effect is the same either way: the proof thins out while you are still in a hospital bed.

The countermeasure is a spoliation letter, formal notice that puts the carrier on the hook to preserve specific categories of evidence, and creates consequences if it destroys them anyway. Getting that letter out is the first thing we do, often the same day we are hired.

How long do I have to file a truck accident claim in Texas?

Two years from the date of the crash, under Texas Civil Practice & Remedies Code § 16.003. Miss it and the claim is barred no matter how strong it is. But the practical deadline is much shorter: the carrier's driver logs and electronic data only have to be kept for six months under federal rules, so waiting even a few weeks can cost you the proof.

What if I was partly at fault for the crash?

You can still recover, as long as you were 50% or less at fault. Texas uses modified comparative fault under § 33.001, your award is reduced by your share of the blame, and at 51% you recover nothing. This is exactly the number the carrier's insurer will fight over, which is why their investigator is at the scene so fast.

How much insurance does a commercial truck carry?

Federal law requires far more than a car. Under 49 CFR § 387.9, an interstate carrier hauling general freight must carry at least $750,000; oil is $1 million; certain hazardous materials are $5 million. Texas only requires $30,000 per person on a private car. That gap is the single biggest reason truck claims are handled differently from car claims.

Who pays, the driver or the trucking company?

Usually the carrier, and often several other parties too. Liability can reach the motor carrier, the broker who arranged the load, the shipper, the company that loaded the trailer, the maintenance contractor, and the trailer's owner. Under the FMCSA leasing rules, a carrier is generally responsible for a driver operating under its authority and placard, even when that driver is technically an owner-operator.
